Terms of Service

1.Interpretation and Definitions
Interpretation
Words with initial capital letters have specific meanings defined below. These definitions apply whether they appear in singular or plural form.
Definitions
Application: The software program provided by the Company, installed on any device, known as Home Design.
Application Store: The digital marketplace (such as Apple App Store or Google Play Store) where the Application is made available.
Affiliate: Any entity that controls, is controlled by, or is under common control with another, where “control” means ownership of at least 50% of voting shares or interests.
Company (referred to as “We,” “Us,” or “Our”): Bloomion Technology, the owner and operator of the Service.
Device: Any hardware capable of accessing the Service, such as a smartphone, tablet, or similar device.
Service: The Application and all related functionality, features, and content provided by the Company.
Subscription: Services or access provided by the Company on a recurring payment basis.
Free Trial: A limited-time, no-cost access period that may precede a paid Subscription.
In-App Purchase: Purchases made within the Application for additional features, services, or subscriptions.
You: The individual or legal entity accessing or using the Service.


2.Acknowledgment
These Terms, together with our Privacy Policy, form the complete agreement between You and the Company. By accessing or using the Service, You agree to these Terms and confirm that You are at least eighteen (18) years old.
If You do not agree with any part of these Terms, please discontinue using the Service immediately.


3.Subscriptions
Subscription Period
Certain features of the Service are available only through paid Subscriptions. Subscriptions are billed in advance on a recurring basis (e.g., daily, monthly, or annually) depending on your chosen plan. Unless canceled, your Subscription will automatically renew under the same terms.
Subscription Cancellations
You can cancel your Subscription renewal through your account settings or directly via the Application Store. Fees already paid are non-refundable, but access will continue until the end of the billing period.
Billing
Payments for Subscriptions and In-App Purchases are managed solely by the Application Store under its own policies. The Company does not process or store payment information.
Fee Changes
We reserve the right to modify Subscription fees at any time. Any changes will take effect at the end of your current billing cycle, with prior notice provided. Continued use of the Service after fee changes means You accept the updated rates.
Refunds
Except where required by law, all payments are non-refundable. Refunds for In-App Purchases or Subscriptions must be requested through the Application Store, subject to its refund policies.
Free Trial
We may offer Free Trials for limited periods. You may be required to provide payment details to begin a trial, but no charges will occur until the trial ends. Unless canceled before expiration, the trial will convert into a paid Subscription automatically.


4.Intellectual Property
All content, design, features, and intellectual property within the Service—including text, graphics, logos, images, and code—are owned by the Company or its licensors and protected by international copyright and trademark laws.
You may not copy, reproduce, or redistribute any part of the Service without prior written consent.


5.Links to Third-Party Websites
The Service may contain links to third-party websites or services not owned or controlled by the Company. We are not responsible for their content, policies, or any resulting damages. Please review their terms before use.


6.Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason—including a breach of these Terms.
Upon termination, all rights granted to You under these Terms will cease.


7.Limitation of Liability
To the fullest extent permitted by law, the Company and its Affiliates shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or privacy, arising out of your use of or inability to use the Service.
In jurisdictions that do not allow certain limitations, our liability shall be limited to the greatest extent permitted by law.


8.“AS IS” Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind—express or implied—including merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Service will be uninterrupted, error-free, or meet every user’s expectation.


9.Governing Law and Dispute Resolution
These Terms are governed by the laws of [Country/Region], excluding its conflict-of-law principles.
You agree to first attempt to resolve any disputes informally by contacting the Company before pursuing legal action.


10.Regional Compliance
EU Users: Mandatory consumer protection laws of your country apply.
U.S. Government Users: The Service qualifies as “Commercial Computer Software” under 48 C.F.R. § 2.101.
Export Compliance: You confirm that You are not in a sanctioned country or on any U.S. government restricted parties list.


11.Severability and Waiver
If any provision of these Terms is found invalid or unenforceable, it will be modified to remain enforceable, and the remaining provisions will stay in effect.
Failure to enforce any right or provision does not constitute a waiver.


12.Translation
If these Terms are translated into other languages, the English version will prevail in case of discrepancies.


13.Changes to These Terms
We may update these Terms periodically. Material changes will be communicated at least thirty (30) days before they take effect.
Your continued use of the Service after updates become effective means You accept the revised Terms.
